By accessing or using this portal, you agree to be bound by these Terms of Use.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Gita Niketan Awasiya Vidyalaya, KKR ("Institution"), governing your use of the NCC GNAV KKR Management Portal ("Portal").

By creating an account or accessing the Portal, you confirm that you have read, understood, and agreed to these Terms, along with our Privacy Policy.

These Terms are governed by the Information Technology Act, 2000, the Indian Contract Act, 1872, and the Digital Personal Data Protection Act, 2023.

2. Eligibility & Registration

• This Portal is exclusively for enrolled NCC Cadets and Associate NCC Officers (ANOs) of Gita Niketan Awasiya Vidyalaya, KKR
• Cadet accounts may only be created by or for students actively enrolled in the NCC unit
• ANO accounts require institutional authorization
• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your login credentials
• Sharing your account credentials with any other person is strictly prohibited

3. Permitted Use

You are permitted to use this Portal solely for:

• Managing your NCC profile and uploading required documents
• Viewing announcements and updates issued by your ANO
• Submitting documents required for NCC activities
• ANOs: managing cadet records, posting announcements, and reviewing cadet documents within their wing

4. Prohibited Conduct

• Uploading false, misleading, or fabricated documents or information
• Impersonating another cadet, ANO, or any official of the institution
• Attempting to gain unauthorized access to other users' accounts or data
• Uploading obscene, offensive, or illegal content
• Using the portal for any commercial purpose or activity unrelated to NCC
• Attempting to reverse-engineer, hack, or tamper with the Portal's systems
• Sharing login credentials or allowing unauthorized persons to access the Portal
• Misusing the document upload feature to store personal files unrelated to NCC
• Scraping, data-mining, or extracting data from the Portal without authorization

Violations may attract liability under Section 43, 66, 66C, and 66D of the Information Technology Act, 2000, and the Indian Penal Code, 1860.

5. Content Uploaded by Users

• You retain ownership of any documents and photographs you upload
• By uploading content, you grant the Institution a limited, non-exclusive licence to store, display, and access that content for NCC administrative purposes only
• The Institution may remove any content that violates these Terms without prior notice
• You are solely responsible for ensuring you have the right to upload any document you submit

6. ANO Responsibilities

Associate NCC Officers using this Portal agree to:

• Access only the data of cadets assigned to their wing
• Use cadet data exclusively for NCC administrative and training purposes
• Not share, export, or misuse cadet personal data
• Ensure all announcements and documents shared through the Portal are appropriate and accurate
• Promptly report any suspected data breach or unauthorized access to the institution

ANOs, as employees or agents of the institution, are bound by Section 43A of the IT Act and the DPDP Act, 2023 in their handling of cadet personal data.

7. Intellectual Property

• The NCC emblem, name, and insignia are protected intellectual property of the Government of India under the NCC Act, 1948 and the Emblems and Names (Prevention of Improper Use) Act, 1950
• The Portal's design, code, and content (excluding user-uploaded content) belong to Gita Niketan Awasiya Vidyalaya, KKR
• You may not copy, reproduce, or distribute any part of the Portal without written permission

8. Disclaimer of Warranties

This Portal is provided on an "as is" and "as available" basis. The Institution makes no warranties, express or implied, regarding:

• Uninterrupted or error-free availability of the Portal
• The accuracy, completeness, or fitness for purpose of any information on the Portal
• The security of third-party services (Firebase, Google Drive) used by the Portal

9. Limitation of Liability

To the maximum extent permitted under Indian law, the Institution shall not be liable for:

• Any loss of data arising from third-party service failures (Google Firebase, Google Drive)
• Unauthorized access due to a user's failure to protect their credentials
• Any indirect, incidental, or consequential damages arising from use of the Portal

10. Account Termination

The Institution reserves the right to suspend or terminate any account that:

• Violates these Terms of Use
• Belongs to a cadet who is no longer enrolled in the NCC unit
• Has been inactive for more than 2 academic years
• Is found to have been registered with false information

Users may also request account deletion by contacting the institution. Upon deletion, personal data will be erased within 30 days as per our Privacy Policy.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Haryana, India.

Reference: Section 75 of the IT Act, 2000 — jurisdiction of Indian courts over offences involving computers in India.

12. Amendments

The Institution reserves the right to modify these Terms at any time. Revised Terms will be posted on this page with an updated date. Continued use of the Portal after any modification constitutes acceptance of the revised Terms.
